1. Introduction

Welcome to HOXTAN. These Terms & Conditions ("Terms") govern your use of the HOXTAN website, mobile application, and related services for buying, selling, and managing digital gold and silver, SIG investments, and jewellery products.

By creating an account, accessing, or using HOXTAN, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Eligibility

  • You must be at least 18 years of age and capable of entering into a binding contract under Indian law.
  • You must provide accurate registration details and complete KYC verification when required to unlock transactions, withdrawals, or jewellery checkout.
  • HOXTAN may refuse, suspend, or terminate access if eligibility or compliance requirements are not met.

3. Account & Security

  • You are responsible for keeping your mobile number, M-PIN, OTP, and device access secure.
  • Do not share OTPs, M-PIN, or login credentials with anyone.
  • Notify us immediately at support@hoxtandigigold.com if you suspect unauthorised access.
  • HOXTAN may block or restrict accounts for security, fraud prevention, or regulatory reasons.

4. Services Offered

HOXTAN may provide, among other things:

  • Live gold and silver rate display and digital metal buy/sell facilities.
  • SIG (Systematic Investment in Gold/Silver) auto-invest plans.
  • Jewellery catalogue browsing, purchase, EMI options, delivery, and related logistics.
  • Old gold / sell-jewellery pickup requests through assigned partners.
  • Wallet credits, offers, goals, invoices, and customer support tools.

Features may vary by region, KYC status, inventory, payment partner availability, and product rules shown in the app.

5. Digital Gold & Silver

  • Buy and sell prices are based on live rates displayed at the time of confirmation and may change quickly.
  • A confirmed transaction is final as per the rate, quantity, and amount shown on the confirmation screen.
  • Holdings are maintained in your HOXTAN account subject to applicable vaulting/partner arrangements and platform rules.
  • Withdrawals, redemptions, and holding periods follow the eligibility and timelines shown in the app.
  • HOXTAN is not liable for market price movement after a transaction is confirmed.

6. SIG Investment Plans

  • SIG plans debit the selected amount on the chosen schedule (daily/weekly/monthly) as per mandate and plan settings.
  • You may pause, resume, or stop a plan where the app allows, subject to plan and payment-partner rules.
  • Stopping a plan does not reverse installments already credited to your holdings.
  • Failed auto-debits due to insufficient balance, mandate issues, or bank declines are your responsibility to resolve.

7. Jewellery Orders & EMI

  • Jewellery products are offered subject to availability, purity/hallmark details, size variants, and pricing shown at checkout.
  • Making charges, packaging, waste, delivery charges, discounts, and GST (where applicable) form part of the payable amount as displayed.
  • EMI jewellery purchases may require a payment mandate/AutoPay and are subject to installment schedules and lender/payment-partner terms.
  • Delivery is available only to serviceable pincodes. Delivery timelines are estimates and may vary due to logistics or verification checks.
  • Cancellation and return eligibility follow our Cancellation Policy and any return rules published by HOXTAN.

8. Payments, Wallet & Refunds

  • Payments are processed through authorised payment gateways / partners. HOXTAN does not store your full card or UPI credentials.
  • Wallet balance, bonuses, and referral credits (if any) are promotional or service credits as defined in the app and may have usage restrictions.
  • Refunds, where approved, are sent to the original payment source or your KYC-registered bank account. Bank timelines may vary.
  • Incorrect bank/KYC details provided by you may delay or fail payouts; HOXTAN is not responsible for such user errors.

9. KYC & Compliance

  • You agree to provide genuine KYC documents (PAN, Aadhaar, bank, face verification, etc.) as requested.
  • HOXTAN may use third-party verification providers to validate identity and bank details.
  • We may freeze, limit, or decline transactions to comply with applicable laws, AML requirements, or fraud checks.

10. Pricing, Taxes & Invoices

  • All prices, rates, charges, and taxes shown in the app at the time of purchase are authoritative for that transaction.
  • Invoices/receipts may be generated electronically and made available in the app or by email where applicable.

11. Prohibited Use

You agree not to:

  • Use the platform for unlawful, fraudulent, or abusive purposes.
  • Attempt to manipulate rates, create multiple abusive accounts, or circumvent KYC/security controls.
  • Interfere with app security, APIs, or other users’ accounts.
  • Misrepresent identity, bank ownership, or delivery details.

12. Intellectual Property

All HOXTAN branding, logos, app design, content, and software are owned by or licensed to HOXTAN. You may not copy, reverse engineer, or misuse them without prior written permission.

13. Disclaimers

  • Precious metal prices are volatile. Past performance is not a guarantee of future returns.
  • HOXTAN does not provide investment, tax, or legal advice. You should make independent decisions or consult your own advisors.
  • Services depend on third parties (payment gateways, banks, KYC providers, logistics). Temporary interruptions may occur.

14. Limitation of Liability

To the maximum extent permitted by law, HOXTAN and its affiliates shall not be liable for indirect, incidental, special, or consequential losses, including loss of profits, data, or goodwill, arising from use of the platform. Our aggregate liability for any claim relating to a transaction shall not exceed the amount actually paid for that specific transaction, except where prohibited by law.

15. Suspension & Termination

HOXTAN may suspend or terminate your access for breach of these Terms, suspected fraud, regulatory requirements, or prolonged inactivity. You may close your account through the app where available, subject to settlement of pending orders, EMIs, or compliance holds.

16. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on the website/app. Continued use after changes means you accept the revised Terms.

17. Governing Law

These Terms are governed by the laws of India. Courts at the competent jurisdiction where HOXTAN operates shall have exclusive jurisdiction, subject to applicable law.
